Unable to see a grandchild? When a couple gets divorced and one parent gets custody, the other parent is still entitled to see their child. The same thing applies to grandparents as well! What a lot of grandparents don't realize is that they are legally entitled to spend time with their grandchildren. Grandparents have legal grandparent visitation rights when it comes to seeing their grandchildren and being denied these grandparent visitation rights is a form of elder abuse and is a violation of elder law.

Even if a grandparent is not seeking any type of custody over their grandchildren, they still wish to visit with them. This is the case a majority of the time; a grandparent is denied their grandparent visitation rights.

Why might someone be denied grandparent visitation rights?
 

There can be a number of reasons for this. One reason is that the parent(s) of the child simply do not get along with their own parents, or their spouse's parents and denies them the right to spend time with their grandchildren.

Not only is it unfair to the grandparent to be denied grandparent visitation rights, but it is unfair to child as well to not be able to see his or her grandfather and/or grandmother.

Unfortunately, there has been an increase in contact restrictions between the grandparents and their grandchildren.

One of the most common scenarios that occurs is when a couple gets divorced. Let's say the wife gets custody of the children, and does not get along with her husband, at all. The wife may choose to not even allow the husband's parents grandparent visitation rights. This happens way too often.
