Our legal services are helpful to persons selling a property, including those who have a broker or salesperson working with them, as well as those who are For Sale by Owner. No matter the situation, once you as a Seller have a Buyer, it is essential that you have an experienced real estate attorney to assist and guide you through the process of a real estate transaction. This does not mean any attorney. You need an attorney who practices in the ever changing world of Real Estate Law.

When selling property you are embarking on a detail oriented transaction. It is likely the largest financial occurrence of your life. The legal documents you will see can be intimidating and truly demand sound legal guidance. Reliable legal advice may be the most wisely spent money of the entire transaction.

The Agreement of Sale sets forth all the terms and conditions of your sale. It contains detailed legal language concerning your transaction. While pre-drafted forms are often used, the blanks on the forms are filled with time-sensitive dates and contingencies that need to be accurately addressed which include establishing price and time of payments, as well as dealing with the various inspection and mortgage contingencies.

We will shape your sale and will negotiate with the Buyer, or their representative, until there is a satisfactory agreement, so you are confident that the Agreement of Sale you are signing is protecting all of your interests and concerns.

In addition to preparing or reviewing the Agreement of Sale, we can review and explain the Seller’s Property Disclosure Statement. This is a document that you as the Seller must complete and give to the Buyer, disclosing material defects in the property prior to closing. It is a highly scrutinized document that has been subject of recent litigation and therefore requires it be prepared accurately. We also review and explain your Uniform Settlement Statement (commonly known as the HUD-1), which is the document that lists all the expenses of both Seller and Buyer for settlement.

While not the responsibility of the Seller to obtain title insurance, it is important for the Seller to have counsel review title documents obtained by Buyer, to determine if there are any encumbrances or defects in title to your property. Finally, if you choose, we can represent you at your settlement, when you close on the property.
