Our law office has extensive experience defending those who are being charged with violating the often times vague conditions of their probation or community control.
When a person is found to be in violation of their probation or community control, they are subject to the same statutory penalties that applied in the original case (ex. if a person is put on probation for a second degree felony such as aggravated battery and is charged with violating that probation, they are subject to the maximum statutory penalties for aggravated battery, which is 15 years in Florida state prison). The problem is that Florida law makes it much easier for the prosecutor to prove the violation than it would have been to prove the original case.
